1. Applicability
1.1. These terms apply to all legal relations between any person and www.divedepo.com, operated by Aquatex Eesti OÜ (registration code 10508414, located at Nõlvaru tee, Jõgisoo küla, 76411, Harju maakond, Estonia), hereinafter referred to as the Divedepo e-shop, arising from the purchase of products from the Divedepo e-shop.
1.2. In addition to these terms, all legal relations arising from purchases made through the Divedepo e-shop are governed by the applicable laws of the Republic of Estonia.
1.3. To ensure the best and most secure service and to support the ongoing development of the Divedepo e-shop, Aquatex Eesti OÜ reserves the right to amend or supplement these terms and the Divedepo price list at any time. All changes are published on divedepo.com and take effect immediately upon publication. If an order is placed before a change takes effect, the legal relations between the customer and Aquatex Eesti OÜ will be governed by the terms in force at the time the order was placed, unless otherwise required by law.
2. Pricing
2.1. The prices listed are valid provided that invoices are paid on time, in accordance with Section 4 of these terms.
2.2. All listed prices include Value Added Tax (VAT) at the rate of 22%.
3. Shopping Cart and Checkout
3.1. You can adjust the quantity of items in your cart at any time. Click update to apply changes, then next when you are ready to proceed to payment.
3.2. On the next page, enter your billing details and click next. You will then be asked to review your order and select a payment method.
3.3. Please verify your billing and delivery details carefully. Accurate information ensures your order is delivered promptly and without issues.
3.4. The purchase agreement becomes legally binding once payment has been received in the bank account of Aquatex Eesti OÜ.
4. Payment Options
4.1. Select a payment method that works best for you on the billing page.
4.2. The following payment options are available:
- Online banking (e.g. PayPal)
- Invoice — click request an invoice on the order confirmation page. You will receive the order confirmation by email, and the invoice will follow once payment is made.
- Credit card
- Direct bank links (available in certain regions)
4.3. If payment is not received within 5 days, the order will be automatically cancelled.
5. Receiving Your Order
5.1. Once the agreement takes effect (see Section 3.4), the ordered product will be dispatched to the address you provided. Delivery scheduling will be coordinated with you via the email address given in your order.
5.2. The courier will deliver the product along with all relevant paperwork within the timeframe shown on the product information page. For full delivery details, please refer to our delivery information page.
5.3. If a product is unavailable and must be ordered from the supplier, or if delivery within the stated timeframe is not possible for reasons outside our control, we will notify you within two business days after the contract takes effect (see Section 3.4) and agree on a new delivery date with you. If the delay causes you to reconsider your purchase, you may cancel the order (see Sections 7.1 and 7.3) and we will refund the full amount paid, including shipping. For made-to-order products, the full amount is billed in advance.
5.4. Upon receiving the product, the courier will contact you to arrange a delivery time.
5.5. The product will be delivered to the address stated in your order. The delivery address cannot be changed after the order has been confirmed.
5.6. Please ensure that your billing and shipping details are accurate to avoid delivery delays or issues. Aquatex Eesti OÜ and the delivery service are not liable for problems caused by incorrect or incomplete information.
5.7. Upon arrival, the courier will present the product together with a delivery note. Before signing, inspect the package for any damage incurred during transit. If you notice damage, note it on the delivery note, take a photo of the damaged item, and contact our customer service immediately at info@divedepo.com. We will replace any items damaged in transit.
6. Customs Duties & Import Taxes
6.1. Orders shipped outside the European Union (EU) may be subject to import duties, customs fees, taxes, or other charges imposed by the destination country. These charges are the responsibility of the customer and are not included in the product price or shipping cost.
6.2. Customs regulations and fees vary by country. We recommend that customers check with their local customs office for detailed information about possible import charges before placing an order.
6.3. If a package is refused at customs or returned due to unpaid duties, any associated costs may be deducted from your refund.
7. Order Cancellation and Product Returns
7.1. After payment but before the product has been delivered, you may cancel your order by sending an email with your order number and bank details to info@divedepo.com.
7.2. You have a 14-day period after delivery to examine the product. If it does not meet your expectations, you may return it within those 14 days by completing the customer service form. If the returned product shows signs of wear and tear, Aquatex Eesti OÜ may decline the return or seek compensation for the reduced value of the item. Any compensation claim will be sent to the email address used for the order. If you disagree with the proposed amount, you may consult an independent assessor to determine the depreciation. The cost of this assessment is shared between you and Aquatex Eesti OÜ, unless one party's claims are clearly unfounded, in which case that party bears the full cost.
7.3. If you cancel your order under Section 7.1 or return the product under Section 7.2, the purchase price will be refunded within 14 days of receiving your return request, provided the product is also returned within that period. This is subject to the conditions outlined in Sections 7.2 and 7.4.
7.4. All returned products must be complete and in their original packaging, including all included items (cables, plastic bags, foam packaging, etc.). If the product was part of a promotional bundle, the entire bundle must be returned.
7.5. The right of return does not apply to products made to your specifications or custom-built per your instructions.
8. Handling Returns for Non-Compliant Products
8.1. Aquatex Eesti OÜ guarantees to address any non-conformities or defects that arise within one year from the date the product is received, for both individuals and legal entities.
8.2. Aquatex Eesti OÜ is not liable for:
- Damage or deterioration caused by the customer or a third party;
- Defects resulting from improper use of the product;
- Ordinary wear and tear from normal use.
8.3. If a product is found to be faulty or does not meet standards, the customer may request a replacement with a compliant, defect-free product, or cancel the order and return the non-compliant product to Aquatex Eesti OÜ.
8.4. In the case of a return for a non-compliant product, the full purchase price, including shipping costs, will be refunded within 30 days following the cancellation of the order and receipt of the contract termination notice.
8.5. In addition to these warranty rights, customers retain all rights granted under applicable law.
9. Liability and Force Majeure
9.1. Aquatex Eesti OÜ and the customer are each liable for any harm caused to the other party by failure to comply with these terms, within the scope and circumstances defined by the applicable laws of the European Union.
9.2. Aquatex Eesti OÜ is not liable for any damages or delivery delays caused by events beyond its reasonable control that it could not have anticipated or prevented (Force Majeure).
10. Additional Provisions
10.1. Personal information provided by customers during their visit to and transactions on the Divedepo e-shop is treated as confidential. A secure data transmission channel with the bank ensures the protection of personal and banking details. The Divedepo e-shop does not have access to this banking information.
10.2. Any matters not addressed in these terms shall be resolved in accordance with the laws of the Republic of Estonia.
10.3. Any disputes arising from orders or purchases made through the Divedepo e-shop between the customer and Aquatex Eesti OÜ shall first be resolved through negotiation. If no resolution is reached, the customer may seek recourse through the Consumer Protection Board, the Commission on Consumer Complaints, or the Tallinn City Court. Complaints may be submitted directly by the consumer or through a representative. Disputes will be resolved in accordance with the laws of the Republic of Estonia.
11. General Notices
11.1. All product images are used for illustrative purposes only.
11.2. Product prices and availability are subject to change without prior notice.
11.3. We reserve the right to cancel orders containing incorrect information caused by typographical errors, technical issues, or bulk purchasing. In the event of an obvious pricing error — for example, a snorkel normally priced at €100 listed at €1 — the Divedepo e-shop may flag the error. Each advertised product is limited to one per customer, and items marked limited quantity may also be purchased only in a quantity of one per customer.
11.4. Product details are regularly reviewed and updated. However, changes may have occurred since your last visit, and manufacturers' websites occasionally contain inaccuracies that may inadvertently appear on our product pages. The Divedepo e-shop is not liable for such errors. We recommend verifying product details by contacting customer support at info@divedepo.com.
